Terms of Service

These Terms of Service ("Terms") govern your use of the PriceWatcher platform and related services ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you may not use the Service.

1. Introduction

PriceWatcher provides tools to monitor product pages, listings, and other URLs you choose for changes such as price, availability, or listing status, and to notify you when those changes occur ("Service"). These Terms form a legal agreement between you ("User") and the provider of PriceWatcher ("Provider"). If you use the Service on behalf of a company or other legal entity, you represent that you are authorized to bind that entity to these Terms.

3. Use of the Service

You agree to use the Service only in compliance with applicable laws, the terms of any websites or platforms you monitor through the Service, and these Terms. You are responsible for any actions taken through your account, for the URLs and content you choose to track, and for ensuring that your use of the Service (including any data obtained from monitored pages) is lawful.

4. Accounts and security

If the Service requires an account, you agree to provide accurate, current, and complete information and to keep your credentials secure. You are responsible for all activity under your account. If you suspect any unauthorized access, you must notify us without undue delay.

5. Acceptable use

You agree that you will not:

  • use the Service for any unlawful, harmful, fraudulent, or abusive purpose;
  • attempt to disrupt, overload, or interfere with the integrity or performance of the Service or underlying infrastructure;
  • reverse engineer, decompile, or attempt to derive the source code of the Service, except where permitted by mandatory law;
  • use the Service to send spam or other unsolicited communications, or to infringe the rights of any third party;
  • use the Service to circumvent technical measures, terms of use, or access restrictions of third-party websites in a manner that violates those sites' rules or applicable law.

You remain responsible for any URLs you add, alerts you configure, and any information you obtain through the Service. You are solely responsible for ensuring that your processing of personal data (including any personal data appearing on monitored pages) complies with applicable data protection and privacy laws (such as GDPR or similar regulations) and with the terms of any third-party sites or marketplaces you monitor.

7. Third-party services

The Service may integrate or interact with third-party services (for example authentication, hosting, email delivery, or payment processing) and depends on the availability and structure of third-party websites you choose to monitor. Those services and sites are provided by independent third parties under their own terms and privacy policies. The Provider is not responsible for the content, availability, accuracy, or performance of any third-party services or monitored pages.

8. Intellectual property

The Service, including all software, interfaces, designs, and content (excluding your own data and configuration), is protected by intellectual property laws and remains the property of the Provider or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You obtain no ownership rights to the Service.

9. Fees and payments

If certain features of the Service are offered on a paid basis, applicable fees, billing cycles, limits on tracked items or check frequency, and payment terms will be communicated separately (for example, on a pricing page or an order form). The Provider may change pricing from time to time, with reasonable prior notice where required by law.

10. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis, without any express or implied warranties of any kind, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The Provider does not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that alerts will always capture every change on a monitored page.

11. Limitation of liability

To the maximum extent permitted by applicable law, the Provider will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

To the extent liability cannot be excluded, the total aggregate liability of the Provider arising out of or relating to the Service or these Terms will be limited to the amount you have paid for the Service, if any, during the twelve (12) months immediately preceding the event giving rise to the claim, or to the minimum amount required by applicable law if higher.

12. Term and termination

These Terms apply for as long as you use the Service. The Provider may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if the Provider decides to discontinue the Service. You may stop using the Service at any time.

13. Changes to the Service and Terms

The Provider may update or modify the Service over time (for example, by adding, changing, or removing features). The Provider may also update these Terms from time to time. If a change is material, the Provider will take reasonable steps to notify you (for example, via the Service or by email). Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes.

14. Governing law and jurisdiction

These Terms are governed by the laws of your local jurisdiction or another jurisdiction specified by the Provider in a separate agreement or legal notice. Any disputes arising out of or in connection with these Terms or the Service shall be submitted to the competent courts of that jurisdiction, unless mandatory law provides otherwise.

15. Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Failure by the Provider to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. These Terms constitute the entire agreement between you and the Provider regarding your use of the Service.
